“Your CM does not know anything”, SC requests Covid death ex-gratia data form Guj, Centre

New Delhi, Nov 22, : , Monday’s Supreme Court criticized the Gujarat government for not following its approved process.Instead of forming a scrutiny panel for ex-gratia payments to the families of Covid-19 victims, it created a committee to review the matter.

In addition, the Centre was asked by the Supreme Court to provide data records from different state governments regarding ex-gratia distributions for Covid death and information about setting up grievance redressal commissions.
In its Oct.4 ruling, the Supreme Court approved Rs.50,000 ex-gratia to the relatives of Covid victims.This was recommended by National Disaster Management Authority.Advocate Gaurav Kumar Bansal pleaded for the passage of this order.

The Gujarat Government’s Solicitor General Tushar Mehta presented his case before the M.R.Justices.Shah and B.V.Nagarathna informed that the amended resolution was issued in accordance with the direction of M.R.Nagarathna.The top court noted that the scrutiny committee seemed to have been an effort to go beyond its directives on November 18.

Mehta stressed that the modified resolution still needs to be tweaked.The bench retorted, “Who was the one who received the initial notification?” “Someone should accept responsibility.” Mehta said that he accepts the responsibility.The bench disagreed and said that Mehta should not assume responsibility.Instead, the responsible officer must be held accountable.

Mehta told the bench at this point that Mehta, the additional chief secretary, had joined the virtual hearing.The secretary was questioned by the bench: “Who wrote this?” This was approved by who? It is the brainchild of whomever it was.The resolution was written in the department and approved by the competent authority.He answered, “Who’s the competent authority?”

The chief minister is the authority competent, he claimed.The court ruled that the chief minister did not have any knowledge.You are here for what, Mr Secretary? You are there for what? The paper further stated that this is a bureaucratic effort to delay the process and make it more complicated.

Mehta mentioned some false claims regarding the compensation.The bench was uncompromising and continued its attack on the Gujarat government.

It would take one year for the certification to be issued by the scrutiny committee, said the bench.

Mehta explained that Mehta was responding to the bench’s question about the final authority for signing documents.

It was pointed out that fake claims could not be an obstruction for legitimate people.Mehta promised the highest court that it will address its concerns and modify the resolution.

He urged the court for the next Monday to be listed.

Also, the bench demanded information on Covid death compensation in Gujarat.

The matter was rescheduled for further hearing by the top court on 29 November.
