Quashing single-bench orders: Malik, Wankhede Sr all on the same page

Mumbai, Nov 29, : Dnyandev Wankhede said that he supported the plea of Nawab Malik, Nationalist Congress Party Minister, to overturn a single-judge decision denying interim relief to Sameer Wankhede Sr.in his defamation case against the NCP leaderAlthough Justice Madhav Jamdars November 22 single-bench order denied interim relief to Wankhede Sr.

, Malik had filed a petition for quashing it as it contained certain observations against him.Malik, in his plea, suggested that the interim application in Wankhede Sr.s suit could be remanded to the same court for a re-hearing of the matter after Justice Jamdar had quashed the order.Wankhede Sr.consented to the formation of a division bench consisting Justice S.J.Kathawalla and Justice Milind Jadhav stated that the single judge order was consensually canceled and remanded it to the single-judge for hearing afresh the interim relief components.Malik was granted time by the division bench to respond to the Wankhede Sr.interim application on December 9, and the latter must submit his rejoinder no later than January 3, 2022.
