New Delhi, Dec 8, 2008 : .The Supreme Court was informed by the Central government that the Law Commission of India had been appointed and its chairperson was being considered by the relevant authorities.

There is no proposal to make it a Statutory Body.
The Law Commission of India conducts research in law, reviews existing laws, and enacts new legislation on the reference made by the Centre and various high courts.It has remained headless since September 2018.

The Centre responded to a PIL filed in February 2020 by Ashwini Kumar Upadhyay.

According to the Law and Justice Ministry the 22nd Law Commission was established on February 21, 2020.The appointment of its chairperson and members is currently under consideration by the relevant authorities.

The Supreme Court was informed by the Centre that the Centre has not received any proposal to make the commission a statutory entity.

The Centre deemed the PIL frivolous, devoid of merits, and stated that the petitioner had raised an issue that falls under the doctrine of separation.

The Centre stated that the government was seized of the matter in relation to the appointment of the chairperson and members of the commission.

The top court sought a response from the Centre on January 25 to the PIL filed in Upadhyay’s name.

The Centre claimed that the petitioner’s averments misled the court into issuing notice of the plea.This plea is liable for dismissal.

The petitioner claimed that due to the non-working of the Law Commission, Centre doesn’t have the benefit of the recommendations of this specialised body on different aspects of law which are entrusted by it for study and recommendations.

The plea asked the top court for direction to the Centre to take the necessary steps to appoint a chairperson as well as members of the Law Commission of India.
