NCPCR asks UP for an appeal against Allahabad HC’s ‘oral sex without minor not assault’ order

New Delhi, Nov 24, : On Wednesday, the National Commission for Protection of Child Rights called on the Uttar Pradesh government for an appeal against an Allahabad High Court decision reducing the sentence of a prisoner in a case of sexual assault involving a minor.

The NCPCR wrote to the Chief Secretary of Uttar Pradesh and stated that "The commission being monitoring organ requests you to take necessary actions in the matter, and file an urgent appeal against this courts judgement." The letter requested further details about the minor, while keeping them confidential to provide legal and other assistance "It was observed by the commission, that the observations made by the high court in the case for commutation sentence of the accused from ten years to seven years and the offence from an aggravated sexual assault (Sections 5, 6) to a penetrative assault (Sections 3, and 4) seem not to be as per the letter, spirit, and letter of the POCSO Act of 2012," the letter stated.

The letter stated that the commutation is prejudicial to the victims justice in this case and that the state must take such necessary steps to appeal against the judgment.avr/ar #NCPCR #asks #Allahabad #oral #assault #Delhi.
