Lahore HC describes’serious legal blunder’ in Pakistani land allotted for Indian nationals

New Delhi, Nov 28, : A puzzled case of what the Lahore High Court has called "a serious legal mistake", a civil judge in Lahore gave Pakistani land to some Indian citizens.Samaa TV reported that the allottees presented their Indian identity documents to him.

People who immigrated to India in 1947 left Mauza Malku in Lahore as evacuee land.Mauza Malki now forms part of the Lahore Cantonment.

Muhammad Umar, son of Jaggu Meo and a resident Mouza Aomra, Indias Ferozpur Jhirka, was allotted at least 23 kanals as well as 9 marlas.The Indian nationals presented documents to the court claiming that Umar had migrated from India to Pakistan and was therefore an "evacuee".

However, Revenue officials cancelled the allotment in 1964 after finding some discrepancies, according to the report.Abdul Rehman and other people filed a case before a Lahore court 45 years later claiming they were the legal heirs to Umar, who had died in 2002.

They asked for the transfer of the 9 Marlas and 23 Kanals of land to them.Rehman and other petitioners including Subhan Khan, Ilyas Kan and Subahni, told the court they are Indian permanent residents.

The report stated that they had submitted their Indian identity documents.The LHC has reproduced these documents in its judgment.

Ironically, the petitioners also submitted a court-issued death certificate showing that Mohammad Umar was killed in India in 2002.According to the report, the certificate names the spot of death as Umra at Ferozpur Jhirka, Indias state of Haryana.

The copies of Indian passports and voter ID cards were among the documents that were submitted to the Lahore civil judge.Indian nationals claimed that Umar’s land was fraudulently transferred after Umar’s death and that it must now be restored to them.
