K’taka HC rejects Chinese woman’s request for visa extension

Bengaluru, Dec 8, 2008 : .The Karnataka High Court rejected the request of a Chinese national for authorities to extend her visa.

It stated that the decision to allow her to stay in India until flight services to China resumed was with the jurisdictional authority.
Justice Krishna S.Dixit, the sole judge, gave the order Tuesday.The Foreigners Registration Office (FRRO), has given the petitioner a notice to Lee Dong, a 42-year-old Chinese woman, to leave India.

She has also approached the court to extend her visa period.She was granted the Visa on June 22, 2019, and she will be granted it again on August 30, 2019.

The bench noted that the petitioner would have already left India by then.

Her visa was extended against the backdrop of the corona epidemic, which lasted until March 30, 2020.

The petitioner applied for a second extension with the authorities.The petitioner approached the court after the authorities failed to make a decision.

International agreements prohibit foreigners from being granted more rights and privileges than they already have.In this situation, it is a matter for abstinence to ask authorities why she is being asked to leave.

The bench also noted that the petitioner remained in the country despite not being granted permission by authorities.

Law states that foreigners must leave the country once their visa period has expired.

The petitioner’s request cannot be considered because she has overstayed in the country.The bench stated that it is up to the authorities to decide whether she can stay in China until flight services resume.
