K’taka HC gives interim approval to hold service prayers at the residence

Bengaluru : , Dec 25, 2005 – The Karnataka High Court granted an interim permission to a woman who will hold prayers in her Udupi district home on Friday.
Esthela Louies, a lady hailing from Udupi has interrogated the police notice she received at the court.

According to her, the Karnataka police’s October 26 notice had violated her fundamental freedoms.Before the court, she prayed that her prayers have been conducted at her home for 11 years.

In their notice, the police said that she had been holding events without permission or license from police and this was against law.She was asked by the police to provide supporting documents.

Justice Krishna S Dixith headed the bench that granted Esthela Louies permission to host service meetings after hearing her plea.The bench also directed her to not disturb neighbours.

It also required her to agree to the conditions that officers are allowed to record audio or video of service meetings.

A court also stated that large congregations should be prohibited in the house.
This order will remain in effect until the next hearing.Esthela Louies claimed in her petition that she had been praying and has participated in community service since 11.

On Fridays and Sundays, prayers will be offered at Devalkanda’s residence in Kundapur Taluk of Udupi.The Kundapura Rural Police Station House Officer issued a notice to her asking about hosting of service meetings.

She also promised to ensure that no large congregation is established, that Covid guidelines are respected and that neighbours do not become disturbed.The petitioner also stated that she will not accept any claims of religious conversion.

Counsel for the government said that petitioner’s home is in a sensitive community area, and her congregation is likely to threaten peace and harmony as well as law and order.
