New Delhi, Nov 29, : .The Supreme Court said Monday that it does not desire any vaccine hesitancy but will listen to concerns in relation to vaccine mandates.
Advocate Prashant Bhhushan representing Jacob Puliyel vehemently argued against vaccine mandates being issued by different state governments.He stated that in Tamil Nadu and Maharashtra, a person cannot leave their home if they are not vaccinated.

Those who are not vaccinated will not be able to receive rations in Madhya Pradesh.

Government officials in Delhi cannot be unvaccinated, and there are restrictions for other states.

A bench consisting of Justices L.Nageswara Rao (B.R.Gavai asked Bhushan to contest these mandates individually.He pointed out that the Centre had replied in RTI to say there was no vaccine mandate.

Bhushan was told by the bench that the matter could not be heard now because it had not received the Centre’s affidavit.It was filed late on Sunday evening.The court said that Bhushan can file an application if he wants to challenge the mandates.

Justice Gavai asked Bhushan: “If your challenge a state government mandate is not to be heard by the state, shouldn’t it?” We adhere to a federal structure.Can we override a mandate issued by a State without hearing them?

Bhushan was told by the bench to record these orders.

Bhushan claimed that the US court of appeals had struck down mandates regarding vaccines in cases where private employers were required to ensure mandatory vaccination.He said that the Meghalaya High Court had also ruled that authorities cannot prevent anyone from opening shops, etc.

The bench stated that if orders are passed in this manner, you will have to challenge them.We agree that vaccine mandates should not be disproportionate to individual liberty.If so, we will investigate it.

The bench, however, refused to accept any general order.

The Centre’s Solicitor General Tushar Mehta stated that any attempt to create vaccine hesitancy by a vested group should be avoided.

He stated that millions of people around the world are using vaccines to protect themselves.

Now, he said, “now we are faced by this minority of people who object”.

He argued that oral observations could have serious adverse effects.The bench responded: “All we have done is bring some specific cases.” We can’t hear anything in abstract.

Although the bench stated that it doesn’t want any vaccine hesitancy to occur, Bhushan’s concerns must be heard.It has scheduled the matter for a further hearing on December 13.

The top court is hearing a petition filed by Puliyel (a former member of National Technical Advisory Group on Immunisation), seeking transparency in clinical trial data and a stay on vaccine mandates.
