Delhi riots: A court frames murder charges against a man who fired a gun at a cop

New Delhi, Dec 8, : .Shahrukh Pathan was captured in a viral video firing a gun at a Delhi police officer during the February 2020 riots in Delhi.

After being arrested on March 3, 2013, Pathan is currently in Tihar Jail.Additional Sessions Judge Amitabh Rawat stated in Tuesdays order that accused Shahrukh pathan raised his pistol straight at Head Constable (HC), Deepak Dahiya, who is taller than him.However, the pistols direction was directed at the cops head.Even the point at which trigger is pulled the gun is aimed straight at Dahiya "Usually, after firing or pulling the trigger, there is an audible jerk and the hands are raised and the pistol is raised because of this audible jerk.

Even the video shows Shahrukh Pathan firing from the pistol in daylight with the aim to kill HC Deepak Dahiya.This is sufficient to charge Shahrukh Pathan with violating Section 307 IPC," the order stated.

It stated that although no injury was caused to Dahiya in the present instance, it does not mean that Section 307 IPC cannot be applied.However, it all depends on the facts of each case.

In the present case, injury seems not to be material.The court ruled that it was clear that accused Shahrukh pathan led a group rioters that formed an illegal assembly at 66 Foota Road at around 2.00 PM on February 24, 2013.They were fully armed with deadly weaponry and committed rioting.

Pathan was charged under sections 147 (punishment of rioting),148 (rioting with a deadly weapon),186 (obstructing a public servant in discharge de duty) and 188 (disobedience duly promulgated or public servant) of IPC.He was also charged under sections 353 and 307 (assault), and section 149 (member unlawful assembly guilty or a common offence) respectively.He pleaded not guilty to the charges and claimed trial.

The court also brought charges against Kaleem Ahmad and Ishtiyak Maklik, Shamim, Abdul Shehzad, and Shamim.After clashes between anti CAA (Citizenship Amendment Act), and pro CAA protesters turned violent, the riots broke out at northeast Delhi in February 2020.

The time of the chaos coincided with the maiden visit to India by then-US President Donald Trump.The riots had claimed the lives of more than 50 people.
