Delhi HC refuses to grant Delhi BJP leaders a summons by the trial court

New Delhi, Dec 8, 2008 : On Wednesday, the Delhi High Court stayed an order by a trial court that issued summons to Ramvir Singh Bidhuri (Leader of Opposition in Delhi Assembly, Delhi BJP MLA) and three other BJP leaders in a complaint of Raghav Chadha.The complaints were made over comments Raghav Chadha made about an alleged multi-crore fraud in the Delhi Jal Board.
Justice Manoj Kumar Ohri gave notice to Chadha, the DJB, and directed the BJP leaders to respond to the matter until the next hearing on March 16, 2022.

Advocates Satya Ranjan Swain and Neeraj Swain filed a petition naming Bidhuri as the opposition leader in the capital.

He claimed that he was the one who exposed the irregularities in the functioning of the Delhi government.

The leader of BJP said that it is crucial for an opposition party to highlight irregularities in a democracy and this process balances a democratic systems.

R.Venkatramani, Senior Advocate, and Ajay Birman appeared for the petitioner.

Additional Chief Metropolitan Magistrate Dharmender Singh, Rouse Avenue district court, ruled that there was sufficient ground to bring proceedings against the respondents — Ramvir Singh Bidhuri (BJP MLA from Badarpur); Vijender Gupta (BJP MLA form Rohini); and Harish Khurana (Delhi BJP media relations spokesperson and in-charge) — under Sections 500 (punishment of defamation), and 33 (common intent) of the Indian Penal Code

However, the DJB has not received any summons or notice from any investigating agency regarding the allegations made.

Raghav Chadha stated that he was informed by the office the law consultant of DJB about the summons.

According to the order, the court was prima facie satisfied that all respondents are summonable due to the allegations in the complaint, the testimonies and the material they have brought on record.

According to the complaint of January 21, 2021, BJP leaders held a press conference where they accused the DJB of committing a Rs 26,000 crore scam.

Advocate Prashant Manchanda brought the defamation case.The complainant claimed that the BJP leaders referred the board as ‘Dalali Jal Board’.

The respondents made defamatory statements about social media, including Twitter and Facebook, and print media that were widely shared on Twitter by the official page for Delhi BJP.

According to the complaint, defamatory content that was spoken and disseminated in the respondents’ case found prominent placement in Hindi newspapers.The DJB claimed in its complaint that the broadcast was also live telecast via the official Facebook page for Delhi BJP.
