Delhi HC asks Centre for its response to plea for live-streaming of same sex marriages

New Delhi, Nov 30, : On Tuesday, the Delhi High Court sought the Centre’s response to a plea regarding live-streaming of same sex marriage proceedings in India.The petitioner called for the recognition of the LGBT community, which makes up nearly eight percent of the country, as a matter national importance.

Live streaming can also be hosted by a larger audience.
The Chief Justice D.N.Justice Jyoti Singh and Justice Patel issued a notice in this matter.They gave time to Centre to respond while posting the matter for further hearing on Feb 3.

In the petition, the Supreme Court cited 2018 as the reason for live streaming of court proceedings in matters of national and constitutional importance.This is referring to SwapnilTripathi vs.Supreme Court of India.

The court heard a series of pleas from members of the Lesbian, Gay Bisexual, Transgender and Queer (LGBTQ+), seeking to have the court declare that same-sex marriages are allowed under the special Hindu and foreign laws.

Neeraj Kishankaul, petitioner’s lawyer, stated that his clients are a large portion of the country’s public and eagerly awaiting the outcome of these cases.

Two women petitioners today sought recognition in India of their marriages that were solemnized abroad.

Notably, the Centre had informed the Delhi High Court on October 25 that “marriage”, which is associated with heterosexual couples, and “spouse”, means husband and wife.

It claimed that there was “some misconception” about the order in the Navtej Johar case, which decriminalized homosexual sex, but did not mention marriage.

The Centre had earlier informed the High Court that acceptance of marriage between individuals of the same gender was not recognized or accepted by any uncodified personal law or codified statutory law.
