Delhi HC requests Centre’s reply on PIL regarding Navy Recruitment Criteria

The Delhi High Court sought to hear from the Centre regarding a challenge to the Indian Navys selection of Person Below Officer ranks (PBORs) for the shortlisting criteriaJustice D.

N.Justice D.N.Patel and Justice Jyoti Singh gave notice to the Ministry of Defence and Chief of Naval Staff and other parties on the Public Interest Litigation, (PIL), filed by Vikram Swami via Adv Ankur Chhibber.On January 11, 2022, the court assigned the matter to a second hearing.

The petitioner claimed that the Indian Navy discriminates in the recruitment of PBORs through the inclusion of shortlisting criteria before the beginning of the initial stage of the selection process.The court, however, refused to issue an interim order ordering the respondents not to accept all applicants who meet the eligibility requirements set out in the advertisement to participate in the selection process.

According to the plea, all persons meeting the criteria set out in the advertisement will be allowed to take part in the three phases of the elimination process.If a candidate meets the eligibility criteria, he cannot be disqualified from the selection process.

After completing the recruiting process, the Navy resorts to shortlisting criteria that are based on written exam and other criteria.Plea read Further, the plea seeks to have the advertisement in employment news dated 16-22 Oct 2021 quashed.

This is because the Indian Navy reserves the right to shortlist the Applicants, increasing their cut-off scores in class 10+2, contrary to what was already stated in the advertisement.Plea states further that such an act of them is irrational.

It does not have any nexus to the object of recruitment.Plea also stated that it removes the legal and legitimate right of candidates, who, despite meeting the eligibility criteria, are barred from participating in the selection process.
