New Delhi, Nov 27, : .A Delhi court expressed concern about Naib Courts — policemen acting as a liaison between a police station in a particular area and jail authorities and the court having jurisdiction over that area — and asked for a report from the Commissioner. Sonu Agnihotri, Additional Sessions Judge, noted that the Naib Courts, despite an earlier circular by Police Department, had not been armed.
The Court also requested separate reports be requested from CP, Delhi and DCP South East.
The court asked the concerned officials to present a charter of duties for prosecution Naib Court, in case it was missing.It found the behavior of one naib unusual and left the Court without informing.
“Let the Charter of Duties of the Prosecution Naib Court, if any, be called from DCP South East and CP Delhi and let it be clarified whether prosecution Naib Courts must be present until Court is functioning as functioning in a Criminal Court has their own security requirements, particularly in the situation when Supreme Court has also taken into consideration security threat to Trial Court Judges,” said the Court.
The Court observed this while dismissing an anticipatory bail plea by one accused in a stalking matter that was later listed for further hearing on Dec 8.
