New Delhi, Nov 24, : On Wednesday, the Delhi High Court directed the Central Adoption Resource Authority to implement various steps to assist foster and biological parents and to obtain the required certification.They also need to get no-objection from the District Magistrates and the foreign authorities. CARA, which is part of the Ministry of Women and Child Development regulates the adoption of abandoned, surrendered and orphaned children.The direction was given by Justice Pratibha Singh while hearing a petition regarding international adoption of Indian children.
The court requested that the adoption authority file a status report within 2 weeks detailing the details of such pending requests and the time they were pending with CARA.
The court requested the authority to inform pending inter-country adoption applicants about the 2021 Regulations.
Under these regulations, families can receive a CARA no-objection certificate to take the child overseas.
The Court directed that all communications with foreign authorities, District Magistrates, or other parties made through CARA must be copied by e-mail to both the party concerned and their authorized representatives.
This will ensure that they are aware of the progress of the application and that the procedure is being followed.This would allow the parties to follow up with the foreign authority or District Magistrate in order to issue the certification.
CARA was requested to establish a 24-hour online or offline helpline to allow adoptive parents to reach the authority at their convenience.CARA will review the feasibility of the same and submit a status report to this Court.
CARA will also consider allowing lawyers to appear as authorized representative to coordinate and facilitate all formalities, the Court stated.
Additional hearings in the matter have been scheduled for December 20, 2021.
