Chennai, Nov 24, : On Wednesday, the Madras High Court rescinded the decision of the AIADMK government to acquire the residence of former Chief Minister, J.Jayalalithaa at Poes Garden as a memorial. Justice N Seshasayee accepted Jayalalithaa’s petition and ordered that Jayalalithaa’s legal heirs J.Deepa & J.Deepak’s decision to acquire the property be canceled and the property be handed to them within three week.
The court also questioned whether it was wise to erect a second memorial to the late Chief Minister, as there is an existing memorial at the Marina.
Deepak and Deepa both pleaded before a court that they were emotionally attached the Poes Garden residence, and that they would create a public trust and charity in her honor.
The siblings also stated to the court that they were not allowed by authorities to object against Veda Nilayam’s acquisition.
This was in total violation the principles of natural justice as mandated under the Land Acquisition Act 2013.
Deepa and Deepak stated in the petition that a Madras High Court division bench had declared them the legal heirs sof Jayalalithaa.
They also requested to establish public trust in her names with a few of her property to go to charity.
They also stated that the state government’s actions to acquire the property and convert it into a memorial would be against the court’s order.
